Why and for what purpose do we process your data?

Processing performed pursuant to a contract:

At OPEN FINANCE, we process your information in order to enter into, maintain and monitor the performance of contracts for products or services that you have concluded with OPEN FINANCE.

Processing performed with your prior consent:

  • Performance of commercial activities to offer you products or services other than those you have contracted with OPEN FINANCE
  • Performance of commercial activities to offer products or services of companies of the business group to which OPEN FINANCE belongs.
  • International transfer of data to OPEN FINANCE suppliers to provide the contracted service or to perform commercial activities to offer OPEN FINANCE products and services. There will be no international transfer of data without your prior informed consent.
  • Sending regular information bulletins or newsletters.

Legitimate interest processing:

  • Performance of commercial activities to offer you products or services similar to those you have contracted with OPEN FINANCE.
  • When you contact OPEN FINANCE, we will process your personal data to manage the delivery of the information you request.
  • In the event that you have sent us your curriculum vitae — so that we can consider your application for any selection procedures that may be in progress.

How long will we retain your data?

We will process your personal data for the duration of our relationship with you. Once the relationship is terminated, the data will be retained for the limitation period of any criminal, civil, commercial or administrative liability that may have been established.

What third parties do we share your information with?

OPEN FINANCE shares your personal data with:
  • Companies of the group to which it belongs, provided that such sharing is necessary for the provision of the contracted service, in particular we share your data with BANCO INVERSIS S.A.
  • Service providers that process your data on behalf of OPENFINANCE as a result of the provision of the contracted service.
  • Service providers outside the European Union for the delivery of the contracted service, or for the performance of commercial activities to offer OPEN FINANCE products and services, as long as their prior informed consent has been obtained.
  • Competent public bodies, tax and social security administrations, courts and tribunals when there is a legal obligation to share it.

What are your rights when you provide us with your data?

You may exercise the following rights:


    Right of access: you can access your personal data included in OPEN FINANCE’s databases or files.

  • Right to rectification: you may request that your personal data be corrected if it is inaccurate or incomplete.
  • Right to erasure (or right to be forgotten): you may exercise this right in certain cases, such as the unlawful processing of your data when the purpose for which it was collected no longer exists. However, there are a number of exceptions in the legislation in which this right does not apply.
  • Right to object: you may request that we do not process your data for specific purposes unless a legitimate interest is demonstrated or it is necessary for the exercise or defence of claims.
  • Right to restriction of processing: you may request that we restrict the processing of your data when processing it (i) if the accuracy of the data is disputed, while we investigate such a challenge, (ii) if the processing is unlawful, but you object to the erasure of your data and request the restriction of the processing instead, (iii) if you are the person who needs it in the event of a complaint (iv) and even if you have objected to the processing of your data for the performance of a task carried out in the public interest or for the satisfaction of a legitimate interest, which must be verified. In these cases, we will only retain the data for the exercise or defence of claims.
  • Right to data portability: this right allows you to receive the personal data that you have provided us with and any data obtained from your contractual relationship with OPEN FINANCE in electronic form.

You may exercise the aforementioned rights of access, rectification, erasure, objection, restriction and portability, as well as revoke the consent given, and, in general, discuss all matters related to the processing of your personal data by contacting:
