At OPEN FINANCE, S.L. (hereinafter, OPEN FINANCE), we would like to provide you with information on how you personal data is processed and your rights, pursuant to the EU’s General Data Protection Regulation (GDPR).

Why do we process your data?

Contractual processing:

At OPEN FINANCE we process your information in order to enter into, maintain and monitor compliance with product or service agreements entered into with OPEN FINANCE.

Processing for which prior consent is obtained:

  • Performance of commercial actions to offer products or services other than those contracted with OPEN FINANCE
  • Performance of commercial actions to offer products or services pertaining to companies in the Group to which OPEN FINANCE belongs.
  • International transfer of data to OPEN FINANCE suppliers to provide the service contracted or to perform commercial actions to offer OPEN FINANCE products and services. No data shall be transferred internationally unless you provide your informed consent in advance.
  • Sending of newsletters on a periodic basis.

Processing on the grounds of legitimate interest:

  • Performance of commercial actions to offer products or services similar to those contracted with OPEN FINANCE.
  • When you make contact with OPEN FINANCE, we will process your personal data to manage the sending of information requested.
  • If you have submitted your CV, to consider you candidacy as part of selection processes that may be run.

How long will we retain your data?

We will process your personal data for the entire duration of our relationship with you. Once this relationship comes to an end, they will be retained for the statutory period of criminal, civil, business or administrative liabilities established

Who will your data be sent to?

OPEN FINANCE sends your personal data to:

  • Companies in the Group it belongs to, provided that this communication is required for the provision of the contracted service, in particular we send your data to BOLSAS Y MERCADOS ESPAÑOLES INNTECH S.A.U.
  • Service providers who process your data in the name and on behalf of OPEN FINANCE as part of the provision of the contracted service
  • Suppliers outside the European Union to provide the service contracted or to perform commercial actions to offer OPEN FINANCE products and services, provided that your informed consent has been obtained in advance
  • Corresponding public authorities, tax and social security authorities and the courts when there is a legal obligation to do so

What are you rights when you provide us with your data?

You can exercise the following rights:

  • Access rights: You can consult your personal data included in OPEN FINANCE’s databases or files.
  • Right of rectification: You may request the modification of your personal data if they are inaccurate or incomplete.
  • Right of deletion (or right to be forgotten): You may exercise this right under certain circumstances, such as the unlawful use of your data or when the purpose for which they were collected ceases to exist. However, a series of exceptions are established in the regulations under which this right cannot be enforced.
  • Right of opposition: you may request that we refrain from processing your data for specific purposes, unless a legitimate interest is demonstrated or they are required to file or defend against claims.
  • Right of limitation: You may request that we limit the processing of your data (i) when their accuracy is challenged, whilst we verify this claim (ii) when processing is unlawful, but your data cannot be deleted, you may request that processing be limited (iii) when you require them in the event of a claim (iv) and when you have opposed the processing of your data to fulfil a mission of public interest or satisfy a legitimate interest, which must be demonstrated. In these cases, we will only preserve your data to file or defend against claims.
  • Right of portability: Enforcing this right, you may and receive, in electronic format, the personal data submitted and any data obtained in terms of your contractual relationship with OPEN FINANCE.

You may exercise the aforementioned rights of access, rectification, deletion, opposition, limitation and portability, and revoke your prior consent, and in general, consult any issues concerning the processing of your personal data by writing to:
